1. Controller
The controller for data processing on this website is:
Mercocon Südamerika GmbH & Co. KG
Unter der Burg 5
93199 Zell
Germany
Phone: +49 (0)9468 90290 00
Email: info@mercocon.com
The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (for example names and email addresses).
2. Visiting this website
This website consists of static pages. It does not use cookies, web analytics, advertising or tracking tools, and it does not embed content from third parties (no maps, videos or web fonts).
When you visit the site, the web server of our hosting provider automatically records technical data in server log files: browser type and version, operating system, referrer URL, host name of the accessing computer, time of the request and IP address. This data is not merged with other data sources. The legal basis is Art. 6(1)(f) GDPR: we have a legitimate interest in the technically error-free presentation and security of the website. Server log files are deleted automatically after 7 days.
The website is hosted by DeltoServices (Netherlands), which processes this data on our behalf under a data processing agreement pursuant to Art. 28 GDPR.
3. Contact by email or phone
If you contact us by email or phone, we store your request and the personal data you provide (for example name and email address) in order to process your request and for follow-up questions. We do not pass this data on without your consent. The legal basis is Art. 6(1)(b) GDPR if your request relates to a contract or pre-contractual measures, and otherwise Art. 6(1)(f) GDPR (our legitimate interest in handling requests effectively) or Art. 6(1)(a) GDPR if you have given consent. The data is deleted once your request has been handled, unless statutory retention periods apply.
4. Job applications
If you send us an application, we process the data you provide (contact details, application documents, notes from interviews) to decide on establishing an employment relationship. The legal basis is Section 26 BDSG, Art. 6(1)(b) GDPR and, where you have given consent, Art. 6(1)(a) GDPR. If we cannot offer you a position, we store your data for a maximum of 6 months after the application process ends, based on Art. 6(1)(f) GDPR. You can object to this storage if you have legitimate interests that outweigh ours. After that period the data is deleted, unless statutory retention obligations apply.
5. Your rights
You have the right to access, rectification, erasure and restriction of processing of your personal data, and the right to data portability. You can revoke any consent at any time by informal email, without affecting the lawfulness of processing before the revocation.
Where we process data on the basis of Art. 6(1)(e) or (f) GDPR, you can object at any time, on grounds relating to your particular situation, to the processing of your personal data (Art. 21 GDPR). We will then stop processing unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves to establish, exercise or defend legal claims.
You also have the right to lodge a complaint with the competent data protection supervisory authority, in particular in the member state of your habitual residence, place of work or the place of the alleged infringement.
To exercise your rights, contact us at info@mercocon.com.
6. Security
This website is delivered over an encrypted HTTPS connection. Email communication over the internet can have security gaps, and complete protection of data against access by third parties is not possible.
